Trademarks for Etsy and Shopify sellers
A shop name on Etsy or Shopify is an account name, not a trademark. Federal protection comes from a USPTO registration.
A shop name on Etsy or Shopify is an account name, not a trademark. Your trademark rights come from using the brand in business and, for nationwide protection, from a registration with the USPTO. This page explains where a small online seller stands and when filing is worth doing.
What you have and what it gives you
| You have | Is it a USPTO registration? |
|---|---|
| An Etsy shop name | No. It is a name on an account the platform controls |
| A Shopify store and domain name | No. A domain registration does not by itself give trademark rights |
| A business or LLC filed with the state | No. See trademark vs LLC |
| A USPTO application or registration | Yes. This is the federal record |
Shop name, brand name or product name
Most sellers should protect the shop or brand name first, because it appears on every listing, package and social post. Product names matter when they are sold as a line, for example a named series of candle scents. A one-off listing title usually does not need its own filing. If your shop name is a plain description of what you sell, such as a name made of only the product word, it may be harder to register, and we say so before you pay.
Marketplace complaints in general terms
Platforms have processes for rights holders to report listings, and for sellers to respond when a listing is reported. What each platform asks for, and how it treats a pending or registered mark, varies and changes. A seller who has received a complaint should keep the notice, avoid deleting listings in a panic and contact us. We can explain the options, though no filing can promise a particular outcome.
When a seller should file
- Before you spend money on ads or a wholesale deal under the name.
- When sales have moved past your home state.
- When another shop starts using a very similar name.
- When you plan a second product line under the same brand.
When waiting is reasonable
A hobby shop that sells a few items locally, or a name you may drop within months, can wait. A search is the cheaper first step. Our free name search shows what the name is up against on USPTO records, which helps you decide whether to file now or keep building.
Fan art and borrowed names
If a listing uses a character, a team name or a famous brand without permission, a registration of your own shop name does not fix it. It also does not give you rights in someone else's mark. Keep the designs and wording you register to what you created.
Choosing classes for a shop
Handmade goods fall in the class that matches the product, such as class 25 for clothing. The store itself sits in class 35. Sellers on Amazon should read Amazon Brand Registry and your trademark.
