Terms of service

Last updated: 3 November 2026. These terms apply to your use of this website and to the services offered by Argos Trademark (“we”). By using the website or ordering a service, you agree to them. If you sign an engagement letter with an attorney, that letter also applies to the legal work.

What we do and who we are

We help people and businesses prepare and file US trademark applications and related filings, and we help inventors with patent applications. Legal services are provided by independent US-licensed attorneys, and patent applications are prepared and filed by a registered patent attorney or agent. We are not a law firm. We are not a government agency and we are not affiliated with the United States Patent and Trademark Office.

Your attorney

Using this website or speaking with our staff does not create an attorney-client relationship. That relationship begins when you sign an engagement letter with the US-licensed attorney assigned to your matter, who is named in that letter. Our website, the free name search, and conversations with our staff are general information. They are not legal advice.

Prices and quotes

Your quote itemises our service fee and the USPTO fee for the number of classes you ask for. Prices shown on the website can change for new orders. A quote you have accepted does not change, except that the USPTO sets its fees and can change them. If a USPTO fee changes before we file, we will tell you the difference before you are charged. Extra classes, office-action responses, statements of use, renewals and other filings are separate services, priced as shown to you before you order. We will not start any recurring charge unless you agree to it in writing.

Payment

Payment is due when you accept a quote and is processed by Stripe. USPTO fees are included in your quote and must be paid before we file.

Refunds

  • If you cancel before we begin preparing your application, we refund our service fee in full.
  • If you cancel after preparation has begun but before we file, we refund our service fee less the work already done.
  • After we file, our service fee is not refundable, except where a filing error was ours and cannot be corrected.
  • If we make an error in a filing, we correct it at no extra charge.
  • USPTO fees that have been paid to the USPTO are not refundable. If we have not yet paid them, we refund them in full.
  • Approved refunds go back to the original payment method.

No promise of approval

The USPTO decides whether a mark is registered. Nobody can promise approval or a timeline. An application can receive objections, be opposed by others, or be refused. If that happens, the USPTO fee is not refunded.

Your responsibilities

  • Give us accurate and complete information, and keep your contact details current.
  • Pay the fees in your quote, including USPTO fees.
  • Make sure you own the mark or have a genuine intention to use it. A filing includes statements made under oath, and they must be true.
  • Answer our requests quickly. If a response is late, an application can be abandoned.
  • Use our services lawfully, and for your own brand.
  • Tell us if you receive any letter or email about your application, so we can check it is genuine.

Deadlines and USPTO contact

To track your deadlines, we or your attorney may be listed as the correspondence contact on your application, and you authorise that. We send reminders, but the application remains yours, and a late response can still lead to abandonment.

Public records

Filings are public. See our privacy policy for what that means for your information.

This website and the free search

The website and the free name search are provided as they are and as available, without warranties. A search result is not a legal opinion. Searches can miss marks and other rights, and the state and federal records we use may be incomplete or out of date. A result does not promise that a mark can be registered or used without conflict.

Our content

The text, design and software of this website belong to us or our licensors. You may not copy, republish or create works from them without our written permission.

Limits on our liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for a service is limited to the amount you paid us for it. Nothing in these terms excludes liability that cannot legally be excluded, and nothing limits the duties your attorney owes you.

Ending the service

You can stop at any time by telling us. We may stop or suspend a service if you do not give us information we need, if you misuse the service, or if the law requires. If we stop for a reason that is not your fault, we refund fees for work not yet done. Refunds are handled as set out above.

Governing law and disputes

These terms are governed by the laws of the State of Wyoming and applicable US federal law.

Arbitration. Any dispute about these terms or our services will be decided by individual, binding arbitration administered by the American Arbitration Association under its consumer rules, and the Federal Arbitration Act applies. Hearings are held remotely where possible. Either side may instead bring an individual claim in small claims court.

No class actions or jury trials. Claims may be brought only on an individual basis, not as a class or representative action, and both sides give up the right to a jury trial.

Opt out. You can opt out of arbitration within 30 days of first accepting these terms by emailing hello@argostrademark.com with the subject “Arbitration opt-out”.

Courts. Any court proceeding that these terms allow, including one to enforce an arbitration award, must be brought in the state or federal courts located in Wyoming.

Changes

We may update these terms. The date at the top shows when they last changed. A change does not affect an order you have already accepted.
