How much does a trademark lawyer cost?
Published prices we reviewed for attorney-assisted trademark filing ran from roughly $500 to $1,550 per class, before or including the USPTO fee, depending on the provider. What you get for that range varies a lot.
A trademark attorney usually costs somewhere between about $500 and $1,550 per class for an application, depending on how the provider prices and what it includes. That range comes from published prices we reviewed in November 2026, and some figures included the USPTO fee while others did not. The first thing to find out is which kind of price you are looking at.
How lawyers charge
| Structure | How it works | Watch for |
|---|---|---|
| Flat fee | One price for a defined piece of work | Exactly which steps are in the price |
| Hourly | You pay for time spent, often against a deposit | No cap, so total cost is hard to predict |
| Hybrid | A flat fee to file, hourly or separate fees after | The price of the second stage |
Usually included
- A search of the name against USPTO records.
- Advice on the class and on the wording of goods or services.
- Preparing and filing the application.
Often charged extra
- The USPTO fee, which is $350 per class at the time of writing.
- A response to an office action when the examiner raises an objection.
- A statement of use for a filing made before the mark is in use.
- Extra classes and descriptions outside the USPTO's pre-approved wording.
- Renewal and maintenance filings after registration.
An application with no objections only needs the first stage. Some applications do receive an objection, so the price of the second stage belongs in your comparison from the start.
Questions to ask before you hire
- Is the USPTO fee in this price, or on top of it?
- Who is the attorney of record, and can I speak with that person?
- What does a response to an objection cost, and is it a flat price?
- What happens with a deadline, and who tracks it?
- Is there a recurring charge for monitoring or reminders?
- What will I pay in total if I add a second class?
What the price range tells you
A lower price may be a flat filing price that leaves out the USPTO fee and any follow-up work. A higher price may include more of the process or come from a traditional firm. Online services that do not use an attorney started far lower, but several added fees and add-ons along the way. We compare the routes side by side in ways to file a trademark compared.
Reading a quote line by line
Ask for the quote in writing and split it into three parts: the provider's price, the USPTO fee and anything described as optional. Then ask what happens if the examiner objects, and what that costs. Two quotes with the same headline number can end up far apart once the second and third parts are added. A provider who is happy to put each line in writing is usually easy to work with later.
Our approach
We quote one itemised total before you spend anything. Our filing price is $499, the USPTO fee is on its own line, and search and deadline tracking are included. A response to an objection has a flat price, quoted before you agree. See the pricing page for the layout.
Is it worth it?
That depends on how much the brand matters and how simple your filing is. Our guide on hiring a lawyer or filing yourself sets out when each makes sense.
